These Terms of Service ("Terms") govern your access to and use of brettking.com (the "Site"), operated by Brett King and Provoke Management ("we", "us", or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Site.

1. Eligibility

You must be at least 13 years of age to use the Site. By using the Site, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Permitted Use

The Site is provided for informational purposes, including learning about Brett King's speaking engagements, consulting services, books, podcasts, media appearances, and upcoming events. You agree to use the Site only for lawful purposes and in accordance with these Terms.

You agree not to:

  • Use the Site in any way that violates any applicable law or regulation
  • Attempt to gain unauthorized access to any part of the Site, its servers, or any connected systems

  • Use Brett King's name, likeness, photographs, or brand materials for any commercial purpose without authorization
  • Remove or alter any copyright, trademark, or other proprietary notices

Limited, non-commercial use of content for personal reference, press coverage, or social media sharing (with appropriate attribution) is generally permitted, provided it does not misrepresent Brett King or his views.

4. Speaking Engagements & Consulting Inquiries

The Site provides a means to submit inquiries for speaking engagements, consulting, and other professional services. Submitting an inquiry does not constitute a binding agreement. All engagements are subject to separate agreements between the parties, including specific terms regarding fees, scope, cancellation, and other conditions.

When you submit information through the Site (such as contact forms or event inquiries), you grant us the right to use that information for the purpose of responding to your inquiry and managing our business relationship with you. The Site contains links to third-party websites, including social media platforms (X/Twitter, LinkedIn, Facebook, YouTube, TikTok), book retailers (Amazon), event registration platforms, and podcast directories. These links are provided for convenience only. We do not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third-party website. Your use of third-party sites is at your own risk and subject to their respective terms and policies.

7. Disclaimer of Warranties

THE SITE AND ALL CONTENT, MATERIALS, AND INFORMATION PROVIDED ON OR THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BRETT KING, PROVOKE MANAGEMENT, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO:

  • Your access to or use of (or inability to access or use) the Site
  • Any content or materials on the Site
  • Any conduct or content of any third party on or linked from the Site
  • Unauthorized access, use, or alteration of your information

In no event shall our total aggregate liability exceed one hundred US dollars (US$100) or the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless Brett King, Provoke Management, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to your violation of these Terms or your use of the Site.

Your use of the Site is also governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference.

11. Termination

We reserve the right to restrict or terminate your access to the Site at any time, without notice or liability, for any reason, including if we reasonably believe you have violated these Terms. Upon termination, all provisions of these Terms that by their nature should survive will continue to apply, including intellectual property provisions, disclaimers, limitations of liability, and indemnification.

12. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts located in New York, New York.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

14. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and Refund Policy, constitute the entire agreement between you and us regarding your use of the Site and supersede all prior agreements and understandings, whether written or oral.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page.
